Supreme Court indictment correspondence regarding defendant competency to stand trial, 1968, 1973


Description

This accession consists of correspondence and files created and collected by the Office of the District Attorney (DA), Kings County, documenting the status and frequent dismissal or closing of criminal cases due to abatement (often triggered in the event of the defendant's death prior to indictment or trial) and, primarily, by reason of mental incapacitation, in the two years of 1968 and 1973. The ultimate resolution of each case documented in the files is unclear, in that many indicate the defendant was found fit to stand trial and motions requesting indictments were submitted. Most frequent document types include memoranda between the DA's office and the Supreme Court, the Department of Corrections, and the Department of Hospitals (or Health and Hospitals Corporation). Accompanying these are court orders, psychiatric examination reports and various legal motions and documents. They document the charges against the defendant and the process by which their competence to stand trial was determined, with ensuing action by the DA's office and/or the departments of Hospitals or Corrections where applicable.
